Before filing a Chapter 7 bankruptcy case, Mr. Haight will analyze the debtor's eligibility for the different forms of debt relief that are available under the Bankruptcy Code and which form of relief is likely to be most beneficial for the client. He will strive to make certain the debtor understands the type of relief that can be obtained and its limitations. To file a bankruptcy case, documents called a Petition, Schedules, a Statement of Financial Affairs, a Statement of Current Monthly Income, and in most Chapter 7 cases, a Statement of Intention, must be prepared correctly and filed with the bankruptcy court. Unless the debtor qualifies for a waiver of the filing fee, the debtor must pay a filing fee to the bankruptcy court. Once the debtor's case starts, the debtor will have to attend the required first meeting of creditors (the 341 Meeting of Creditors) where the debtor may be questioned by a court official called a "trustee" and by creditors. Mr. Haight will be in attendance with the debtor at this meeting.
